Arkansas to permit charities to avoid placing children with same-sex couples

Arkansas Governor Sarah Huckabee Sanders recently signed a bill, known as Act 509 or the Keep Kids First Act, into law. This new law prohibits state officials from compelling faith-based adoption and foster care organizations to place children in homes that go against the agency’s religious or moral beliefs. The bill also prevents government action against adoptive or foster parents based on their religious beliefs or refusal to support government policies on sexual orientation and gender identity.

Supporters of the law, such as the Alliance Defending Freedom, argue that every child deserves a loving home and that the law prioritizes the well-being of children by preventing discrimination against adoption and foster care providers based on their religious beliefs and convictions. However, critics, including the ACLU of Arkansas, believe that the law codifies discrimination and excludes LGBTQ individuals and couples from fostering or adopting.

This legislation is part of a broader national debate over whether Christian charities working with government agencies should be required to adhere to antidiscrimination laws regarding sexual orientation and gender identity. In 2021, the Supreme Court ruled in Fulton v. City of Philadelphia that officials could not exclude Catholic Social Services from its foster care program solely because the organization refused to place children with same-sex couples.

The signing of Act 509 in Arkansas has sparked both support and opposition, highlighting the ongoing tensions between religious freedom and anti-discrimination efforts in the realm of adoption and foster care.
