Arkansas governor prioritizes state law over new Title IX rule with executive order


Arkansas Governor Sarah Huckabee Sanders signed an executive order prioritizing state law over new Title IX regulations that include protections for LGBTQ+ students. The U.S. Department of Education announced last month that the final rule protects students and employees from sex-based discrimination, requires schools to offer support to complainants, and codifies protections for transgender students.

During a press conference, Governor Sanders criticized the changes as a “reinterpretation” of Title IX that erases women. She vowed that Arkansas would not comply with the new regulations if the Biden administration threatened a loss of federal education funding. Several Republican-led states, including Louisiana, Tennessee, and Florida, have filed legal challenges against the regulations.

The executive order directs public schools in Arkansas to follow state law, including Act 317 of 2023, which defines sex based on biology, mandates sex-based restroom and sleeping quarters designation, and prohibits employees from being required to use preferred pronouns. Governor Sanders also signed an executive order in October banning gender-neutral language in state government documents.

The American Civil Liberties Union of Arkansas criticized the executive order as an attack on the well-being and freedoms of LGBTQ+ individuals.
