Following Matt Gaetz’s resignation from the House and withdrawal from consideration for Attorney General, questions have arisen about his future in politics. While he resigned from the current Congress, he was re-elected to represent his Florida district in the upcoming session starting in January. However, his resignation is effective and he cannot return to the current Congress.
The situation for Gaetz returning to the 119th Congress is complicated. In his resignation letter, Gaetz stated he did not intend to take the oath for the next term, but a special election to fill his seat has not been organized yet. House Speaker Mike Johnson expressed hope for a quick election to fill the seat. It remains uncertain if Gaetz will reverse his decision not to take the oath.
The Ethics Committee investigation into Gaetz could continue if he returns to Congress, as the committee can vote to extend investigations into members. If Gaetz does not return, Ethics Committee Chair Michael Guest believes the committee’s involvement in the matter should end. However, there is still push from some Democrats, like Rep. Sean Casten, to compel the committee to release its report. This matter will be addressed after Thanksgiving.
In the meantime, Gaetz’s political fate remains uncertain as he navigates the aftermath of his resignation and potential return to Congress.
