Mississippi Sierra Club Files Lawsuit Against the Mississippi Public Service Commission

Mississippi Solar Advocates Challenge Public Service Commission’s Decision

JACKSON, Miss. – Solar advocates in Mississippi are mobilizing against a controversial decision made by the Mississippi Public Service Commission (PSC), which suspended crucial solar programs and incentives earlier this year. A court hearing addressing this decision took place on Thursday, with key environmental groups, including the Mississippi Sierra Club, urging for the reinstatement of these initiatives.

Representatives from the Sierra Club expressed their outrage, calling the PSC’s April 2024 ruling “appalling.” Louie Miller, a spokesperson for the organization, criticized the lack of consultation prior to the rule’s suspension, which he argued undermined incentives for solar investment and battery storage. The commission’s decision, which passed with a 2-1 vote, was articulated by Chairman Chris Brown, who stated, “We don’t have a problem with people doing rooftop solar, just don’t charge your neighbor for it.”

The suspension has raised serious concerns about its impact on Mississippi families, businesses, and public schools. Will Shirley, CEO of Sundown Solar Power Developers, indicated that the ruling could adversely affect consumers who have benefited from previous solar incentives.

Responding to the legal challenges, the Attorney General’s office filed a response on behalf of the PSC to the Hinds County Chancery Court. The Mississippi Sierra Club has been granted until December 6 to submit their reply before the court hears further arguments.

The ongoing dispute highlights the tensions between regulatory measures and the push for sustainable energy solutions in Mississippi, with advocates continuing to pressure the PSC for a reversal. As the debate unfolds, the future of solar energy incentives in the state hangs in the balance.
